Driving Without a Valid License
08.04.2025Our client was accused of operating a motor vehicle without holding a valid driver's license. In fact, he possessed an Iraqi driving license, which had already expired and was no longer recognized in Germany.
He had been advised at an early stage that he needed to obtain a German driver's license and that doing so would be important to demonstrate during the court hearing.
By presenting a well-structured and chronological account of the events - particularly focusing on what our client was aware of at each point in time - it became clear to both the judge and the public prosecutor that any culpability was minor and, at most, constituted a case of negligence.
The proceedings were ultimately conditionally suspended pursuant to Section 153a (2) of the German Code of Criminal Procedure (StPO), subject to the payment of a monetary sum.
What a great result!
