Environmental criminal law

Environmental crimes are a very complex section of the German criminal law. The question wether a specific behaviour qualifies as an environmental crime is accessory to administarive regulations. Therefore, expert reports often are necessary on the decision whether the suspect has violated the law or not. Environmental offenses are often committed by companies.

In environmental criminal law the objective of the defense is to investigate the correct legal situation and find evidentiary problems.

  • unauthorized operation of facilities, § 327 StGB
