Non-opening of the main proceedings obtained

Our client was completely distraught when he contacted our law firm seeking advice. He had wrongly received an indictment in which he was accused of having shown “dickpics” to children. The public prosecutor's office was of the opinion that the client was sufficiently suspected of this - merely alleged - act of sexual abuse of children without physical contact with the child (Section 176a StGB). The file was immediately requested and discussed in detail with the client. A comprehensive statement was drawn up, evaluating all incriminating statements. In this statement, it was explained in detail that the statements of the only witnesses for the prosecution contradicted each other, were obviously an act of revenge against our client and could not be true. The statement also convinced the court. The court decided not to open the main proceedings as requested by the public prosecutor's office. Our client is overjoyed that we were able to conclude the proceedings discreetly and obtain a decision in the interests of justice.
